Terms and Conditions Of Service For Individual Students

1. IDENTIFICATION AND PURPOSE

This document regulates the contracting of language teaching services provided by Benjamin Cooper (NIF: Y8337159H), residing at Av. Gran Capitán, Córdoba, 14008 (hereinafter, "the Teacher").

Services Included: These conditions apply both to individual teaching (Private Students) and to group teaching (Courses and Conversation Groups).

Definitions: "Student" shall be understood as the natural person receiving the training, and "Client" as the person making the payment (which may be the same person or, for example, the parent/guardian in the case of minors).

Nature: The activity is Non-Regulated Teaching (private training). Certificates issued do not carry official status.

2. STRUCTURE AND DURATION OF CLASSES

Teaching Duration: Each contracted class defaults to a 1-hour block booked on the calendar. Of this time, 55 minutes are allocated to direct teaching, while the final 5 minutes are dedicated to concluding the session and the Teacher's pedagogical preparation for the next lesson. If the Student or Client of individual classes requires a session of longer or shorter duration, they may contact the Teacher to request a custom adaptation, with a minimum limit of 30 minutes per class.

Monthly Group Packages: Group classes are sold in fixed packages (usually 4 sessions per month). These classes will be taught on a fixed weekly day and time predetermined during the corresponding month. Due to the collective nature and closed calendar of the group, if a Student does not attend a scheduled session, the class will proceed with the rest of the group and will not be makeup-eligible or refundable.

Platform and Access: Classes will be conducted by default using the Google Meet videoconferencing platform. The Student will receive the corresponding access link via the usual contact method prior to the start of the session, usually 5 to 10 minutes in advance.

Use of Other Platforms: The Teacher is willing to conduct the class using different videoconferencing software if requested by the Client or Student. However, if said platform requires payment for a subscription or license to allow the class to be taught for the full agreed duration, this additional cost must be expressly assumed by the Client prior to the session.

In-Person Option (Residents of Córdoba, Spain): Classes are generally taught online. However, if the Student resides in the city of Córdoba (Spain), they may request in-person individual classes. This option must be explicitly requested and agreed with the Teacher prior to purchasing the class pass/session and prior to payment; otherwise, it will be understood by default that training will take place online. Additionally, the Teacher reserves the right to apply a travel surcharge or additional fee, depending on the distance to the agreed location.

3. TRIAL CLASSES

Free and Without Obligation: The trial class is completely free of charge and does not imply any subsequent obligation or commitment on the part of the Client or Student.

Duration and Punctuality: The trial session will have a fixed duration of 20 minutes. Exactly the same rules regarding punctuality and grace period indicated in the Cancellation and Punctuality Policy section will apply.

Payment Options: Once the trial class has ended, if the Client decides to continue with classes, they may pay directly through the website or request that the Teacher issue the corresponding invoice.

Start of Classes: Classes agreed upon following the trial session will not begin until the corresponding payment has been received.

4. FINANCIAL CONDITIONS AND PAYMENT METHODS

4.1. Prices and Taxes (VAT Exemption)

Prices indicated in the current rates are exempt from VAT in accordance with Article 20.1.9º of Law 37/1992, of December 28, on Value Added Tax (language teaching). As this is a service provided to private individuals (end consumers), the final price does not involve personal income tax (IRPF) withholdings by the Client.

4.2. Payment Methods and Deadlines

The Client may pay for services using the following methods depending on the option contracted:

Direct Payment (Bank Transfer or Bizum): For individual sessions paid via bank transfer or Bizum, payment must be completed within a maximum period of 5 calendar days from the dispatch of the invoice or payment request. Completing payment within this period is essential to guarantee the reservation of the slot and schedule availability; otherwise, the Teacher may offer the slot to other students.

Recurring Monthly Subscriptions (Credit/Debit Card): Subscriptions contracted through the website will be processed automatically via recurring charges to the bank card provided by the Client at the time of purchase.

Monthly Group Packages (Single One-Time Payment): Payment for 4-class group packages is made via a single one-time (non-recurring) payment for each month the Student wishes to participate, using the methods enabled on the web (card, transfer, or Bizum). Group slot reservations will only be guaranteed once the complete package is paid prior to the start of the monthly cycle.

4.3. Validity and Expiration of Classes

Individual Class Passes and Single Classes: Classes or passes purchased individually (without a subscription) generally expire 6 months from their purchase date. Once this period has elapsed, unused sessions will be considered expired without right to a refund.

Recurring Individual Subscriptions (Roll-over): In the individual subscription model, unused classes at the end of the month will roll over automatically to the next billing cycle. These accumulated classes will remain active as long as the subscription remains active. In the event of subscription cancellation, accumulated classes must be consumed within a maximum period of 6 months from the date they were issued.

Monthly Group Packages: Unlike individual options, group packages are valid exclusively for the calendar month or 4-week period contracted. Classes not consumed or used by the Student within the dates set for that month will expire at the end of the period, with no possibility of rollover, extension, or partial refund.

4.4. Automatic Renewal and Subscription Cancellation

Renewal: Recurring individual subscriptions will renew automatically each month indefinitely until cancelled. The system will send a reminder email 7 days prior to the renewal date. (Note: Group packages do not renew automatically and require a manual purchase for each desired month).

Cancellation: The Client may cancel their individual subscription at any time without penalty from their user account on the website or by written notification (info@bensworldofenglish.com) at least 48 hours prior to the next charge. Cancellation will stop future charges, but the Student retains the right to use the classes from the period already paid.

5. RIGHT OF WITHDRAWAL (ONLINE SALES)

In accordance with Law 3/2014, the Client has the right to withdraw from the contract within 14 calendar days without giving any reason.

Exception: If the Client requests to start classes (individual or group) before the end of the 14-day period, they expressly accept that they will lose their right of withdrawal once the first class of the package or subscription has been executed.

6. TAX DEDUCTION IN ANDALUSIA

Clients residing in Andalusia may benefit from a regional tax deduction of 15% on amounts paid for school and extracurricular language instruction, up to a limit of €150 per year per descendant. To this end, the Teacher will provide the corresponding invoice containing the required details (payer's NIF and student's details) upon the Client's request.

7. CANCELLATION, PUNCTUALITY, AND ATTENDANCE POLICY

Individual Classes (Prior Notice): Individual class students may reschedule or cancel a session at no cost by giving a minimum of 12 hours' notice. Once that period has passed, no cancellations or rescheduling will be accepted under any circumstances, and any notice given less than 12 hours in advance or non-attendance will result in a 100% charge of the class fee, with the session counted as used.

Group Classes (Non-attendance): Due to the collective nature and fixed schedule of group classes, no cancellations, rescheduling, or refunds are permitted for Student non-attendance to a group session, regardless of how far in advance notice is given. If the Student does not attend, they forfeit the session.

Cancellation of Group Session by the Teacher: If due to force majeure the Teacher must cancel a group session, an alternative makeup date will be proposed for the entire group, or the proportional amount equivalent to that session will be refunded/deducted.

Grace Period: The Teacher will wait a maximum of 15 minutes at the start of the session (both individual and group). If no Student shows up or gives notice within that time, the class will be considered ended and billed/counted in full.

Final Termination: Once the 15-minute waiting period has passed, the Teacher will not resume the class under any circumstances, even if the Student appears afterward.

8. RIGHT OF ADMISSION, CONDITIONS OF SERVICE PROVISION, AND REFUNDS

Admission Criteria: In accordance with current consumer regulations, the Teacher reserves the right to accept, deny, or discontinue teaching services based on objective criteria, such as schedule availability, formation of the minimum required group size, compatibility of pedagogical objectives, or the scope of professional specialization. Discriminatory criteria will not be applied under any circumstances.

Termination for Incompatibility or Availability: Should the Teacher decide not to continue providing classes to a Student for organizational or pedagogical suitability reasons, written notification will be given to the Client at least 7 calendar days in advance. In this scenario, the Client will receive a pro-rata refund for prepaid, unused classes remaining within their validity period, processed within a maximum of 14 calendar days via the original payment method. Classes already taught or expired are non-refundable.

Termination for Breach or Serious Infringement: The Teacher may terminate the contract immediately and without prior notice in cases of disrespectful behavior, harassment, non-payment, or repeated failure to comply with these Terms and Conditions. In the event of termination for reasons attributable to the Student or Client, only unused classes within their validity period will be refunded, and the Teacher reserves the right to claim damages resulting from such conduct.

9. DISCLAIMER OF LIABILITY FOR RESULTS

The Teacher undertakes to teach the subject matter with maximum professional diligence. However, specific results on official exams (Cambridge, IELTS, etc.) are not guaranteed, as success depends on the Student's individual study and effort.

10. DATA PROTECTION AND GROUP CONDUCT

Data Processing: Personal data provided will be processed in accordance with the GDPR (EU) 2016/679 solely to manage classes, billing, and communication with the Student/Client. Data will not be transferred to third parties unless required by law.

Intellectual Property: Educational materials provided are for the personal and private use of the Student. Public or commercial distribution, as well as recording class sessions without the express consent of the Teacher, is prohibited.

Privacy and Group Conduct: In group classes, the Student agrees to maintain respectful conduct toward the Teacher and fellow classmates. Audio or video recording of group sessions, taking screenshots, and unauthorized dissemination or sharing of personal data, contact details, or access links of other group members are strictly prohibited.

11. DISPUTE RESOLUTION AND JURISDICTION

In the event of a dispute, the parties submit to the Consumer Arbitration Board of Córdoba as the preferred and free avenue for conflict resolution. Failing that, jurisdiction belongs to the Courts of Córdoba.
