Terms and Conditions Of Service For Individual Students
1. IDENTIFICATION AND PURPOSE
This document regulates the hiring of language teaching services provided by Benjamin Cooper (Tax ID/NIF: Y8337159H), residing at Av. Gran Capitán, Córdoba, 14008 (hereinafter, "the Professor").
Definitions: "Student" shall mean the natural person receiving the training, and "Client" shall mean the person making the payment (these may be the same person or, for example, a parent/guardian in the case of minors).
Nature: The activity is Non-Regulated Education (private training). Certificates issued do not have official status.
2. TRIAL LESSONS
Free of Charge & No Obligation: The trial lesson is completely free of charge and carries no commitment or obligation of any kind on the part of the Client or Student.
Duration & Punctuality: The trial lesson will last 25 minutes. The exact same punctuality and grace period rules outlined in the Cancellation and Punctuality Policy section apply to trial lessons.
Payment Options: Following the trial lesson, should the Client choose to proceed with regular classes, payment may be made directly through the website or via an invoice issued directly by the Teacher.
Commencement of Classes: Any classes scheduled following the trial lesson will not begin until the first payment has been received or valid proof of payment has been provided.
3. ECONOMIC CONDITIONS
Prices and Taxes: Prices indicated in the current rates are exempt from VAT according to Art. 20.1.9º of Law 37/1992. As this is a service for individuals, the final price does not involve IRPF withholdings by the Client.
Validity of Course Packs: Packs of 4, 8 (or any other variant) expire 6 months after the date of purchase. No refunds will be issued for unused classes once this period has elapsed.
Payment Methods and Deadlines: Payment must be made in full within 5 calendar days of the invoice issuance via bank transfer or Bizum. The Professor reserves the right to suspend classes if payment is not verified.
Tax Deduction: For residents in Andalusia, these services may be eligible for a 15% regional tax deduction (up to a limit of €150) for language training. The Client is responsible for verifying their eligibility for this deduction in their tax return.
4. RIGHT OF WITHDRAWAL
In accordance with current consumer legislation, for contracts concluded remotely, the Client has the right to withdraw from the contract within 14 calendar days without justification. If the service has already begun during this period at the express request of the Client, the proportional part of the classes already taught must be paid.
5. CANCELLATION AND RESCHEDULING POLICY
Notice Period: The Student may reschedule or cancel a class at no cost by notifying the Professor at least 12 hours in advance.
Late Cancellations: If notice is given less than 12 hours before the session, the class will be considered taught and the corresponding amount will be deducted from the block or charged to the Client.
Technical Issues: If the class cannot be held due to technical failures on the Professor's side, it will be rescheduled at no cost. If the failure is on the Student's side, the 12-hour rule applies.
6. PUNCTUALITY AND COURTESY WINDOW
Waiting Time: The Professor will wait for a maximum of 15 minutes for the Student's connection (online) or arrival (in-person).
No-show: After 15 minutes of waiting, the Professor will exit and not resume the class under any circumstances, even if the Student appears afterward.
7. RIGHT OF ADMISSION, TERMS OF SERVICE, AND REFUNDS
Admission Criteria: In compliance with applicable consumer protection laws, the Teacher reserves the right to decline or discontinue the provision of teaching services based on objective operational criteria, including schedule availability, alignment of pedagogical goals, or professional scope. Under no circumstances will discriminatory criteria be applied.
Termination for Operational or Pedagogical Reasons: Should the Teacher decide to discontinue classes for reasons related to availability or learning fit, written notice will be provided to the Client at least 7 calendar days in advance. In such cases, the Client will receive a full pro-rata refund for any unused, pre-paid classes that remain within their active 6-month validity period, processed within a maximum of 14 calendar days via the original payment method. Classes already delivered or expired are non-refundable.
Termination for Cause or Misconduct: The Teacher reserves the right to terminate services immediately and without prior notice in cases of disrespectful behavior, harassment, non-payment, or repeated failure to comply with these Terms and Conditions. In cases of termination due to client fault, unused sessions within their validity period will be refunded pro-rata, without prejudice to any legal remedies the Teacher may pursue for damages.and the session will be charged in full.
8. DISCLAIMER OF RESULTS
The Professor commits to teaching the subject matter with maximum professional diligence. However, the achievement of specific results in official exams (Cambridge, IELTS, etc.) is not guaranteed, as success depends on the individual study and performance of the Student.
9. DATA PROTECTION
Personal data provided will be processed in accordance with the GDPR (EU) 2016/679 for the sole purpose of managing classes, invoicing, and communication with the Student/Client. Data will not be shared with third parties except under legal obligation. Teaching materials provided are for the personal and private use of the Student. Their public or commercial distribution, as well as the recording of class sessions without the express consent of the Professor, is prohibited.
10. DISPUTE RESOLUTION AND JURISDICTION
In the event of a dispute, the parties submit to the Consumer Arbitration Board of Córdoba as the preferred and free route for conflict resolution. Failing that, the jurisdiction shall be that of the Courts and Tribunals of the Student's place of residence.
